![]() The hypothetical quote above is a classic example of a speaking objection. “If you’re asking my client…then you already know the answer because they previously testified…which is the answer to your question.” Handled adroitly, speaking objections will only tie defense counsel into expensive knots. Defense browbeating is not an acceptable tactic. Our clients have a right to certain information being obtained. Ultimately, these tactics will lay the groundwork for a motion to compel and secure sanctions against the offending defense attorney. This article aims to arm young attorneys with tactics and knowledge to control the hostile defense lawyer. Such improper efforts to limit the scope of questioning must be defeated. Too often defense attorneys improperly object, trying to bully younger plaintiffs’ attorneys during depositions. The deposition may then be used as fully as though signed, in accordance with paragraph (i) of this section. How to Put a Cork in the Defense's Speaking Objections If the deposition is not signed by the deponent within thirty (30) days of its submission to him/her, the official reporter shall sign the deposition and state on the record the fact of the waiver of signature or of the illness or absence of the deponent or of the refusal to sign, together with a statement of the reasons therefor. ![]() The deposition shall then be signed by the deponent, unless the deponent waives signature or is ill or cannot be found or refuses to sign. Any change in form or substance which the deponent desires to make shall be entered upon the deposition by the official reporter with a statement of the reasons given by the deponent for making them. When the testimony is fully transcribed, the deposition shall be submitted to the deponent for examination and signature and shall be read to or by the deponent, unless such examination and signature are waived by the deponent. Upon request by any party, the testimony recorded at a deposition shall be transcribed. If the Presiding Officer determines that an answer does not comply with the requirements of this section, he/she may order that the matter be deemed admitted or that an amended answer be served. The party who has requested an admission may move to determine the sufficiency of any answer or objection in accordance with § 1025.36 of these Rules. ![]() A party who considers that a matter to which an admission has been requested presents a genuine issue for hearing may not, on that ground alone, object to the request but may deny the matter or set forth reasons why the party cannot admit or deny it. ![]() An answering party may not give lack of information or knowledge as a reason for failure to admit or deny a fact unless the party states that he/she has made reasonable inquiry and that the information known or readily available to him/her is insufficient to enable him/her to admit or deny a fact. When good faith requires that a party qualify an answer or deny only a part of the matter to which an admission is requested, the party shall specify the portion that is true and qualify or deny the remainder. A denial shall fairly meet the substance of the requested admission. The answer shall specifically admit or deny the matter or set forth in detail the reasons why the answering party cannot truthfully admit or deny the matter. The matter about which an admission is requested will be deemed admitted unless within thirty (30) days after service of the request, or within such shorter or longer time as the Presiding Officer may allow, the party to whom the request is directed serves upon the party requesting the admission a written answer or objection addressed to the matter, signed by the party or the party's representative and stating the reasons for the objections.

When we got to the island opposite the Memorial car park, we paddled round it, past some incredible properties on the waters edge. We both managed to stand up on the boards, despite both falling in a couple of times! The water wasn't shockingly cold, at 17.5 C, after falling in I even had a little swim in the river which was refreshing. We paddled along the river, taking in the scenery, lush green river banks and surprisingly clear water beneath us. Owen getting the hang of paddle boarding (Image: Lauren Cole-Lomas) The journey takes around 30 minutes, where you take a turn round a little island, and back to the Pleasure Grounds. Once we were out on the water, we paddled up towards the Memorial's car park. He made sure to thoroughly explain how to stand up, and what to do in an emergency, making sure to help with any beginners nerves. Nick is a qualified instructor, and gave us a quick tutorial before we set off, as Owen had never tried paddle boarding before (I am well seasoned in water sports). He gave us all the gear and a buoyancy aid before we got on the water. Owner Nick met us down by the riverside, and made sure we had a briefing with river rules and what to do in an emergency. If paddle boarding isn't your thing or you are scared of falling in the water, you could try kayaking instead, however I don't mind falling in the water I enjoy a little nature swim. No. If you are a fan of the music or just looking for a good horror movie ( a thing quite hard to come about these days) this movie is for you. It ends with the first new Twisted Sister song in a long time with all the original members. The soundtrack and movie starts with a dark and dim solo outing from Snider that sets the mood of the movie. The soundtrack combines today's great metal acts with yesterdays classic styling. With every good horror movie comes a good soundtrack and this is no acceptation. Definitely not for the faint of heart of the squeamish. Some may not even make it past the movie's box which features a picture of a girl with her mouth sewn shut. There is something here to make just about everyone turn there head in disgust. What we have here is a trip through Sniders sick and twisted mind. So again Howdy goes after Gages daughter and Englund. Target #1 for Howdy, seek revenge on Gage who could have stopped the whole thing but decided to just sit back and watch. Well the death of Howdy is unsuccessful and Howdy becomes his same old self again. As fate would have it Gage sees the whole thing happen. Wanting to see the demise of Howdy an angry mob breaks into his house and take him away. Along comes Robert Englund as a redneck beer drinking slob who decides to take matters into his own hands. But the towns folk want nothing to do with him and want to see him dead. Four years later Howdy is released a new man. Through the help of his niece (Amy Smart) he tracks down Howdy and takes him into custody. Well after the girls go missing the one girls father, Inspector Gage (played by Kevin Gage) goes on a search for his daughter. Well of course Howdy being the strange and sick person he is invite's the two girl's to a party where he later inflicts all kinds of disturbing pain and torment. But all that aside it is the story of two girls who one night meet our antagonist, Captain Howdy ( played here by Snider himself). This is a fairly unknown movie because the NC-17 rating didn't give it much help at the box office and lets admit it people, S&M doesn't exactly make for good clean family entertainment. "Dee Snider's Strangeland" a movie he not only wrote but produced and starred in as well. But he has shifted gear, this time he is writing a movie. Now brings us to 1998 where Snider has began to write again. Snider brought us such great anthems as "We're Not Gonna Take It" and "I Wanna Rock". For those of you who don't know, or maybe just don't remember Dee Snider was the head of the famous old school metal band Twisted Sister. To start, squeeze a small amount of paint onto your clean palette. Use one sheet of Bristol board for each color family: whites, reds and oranges, yellows, blues and purples, greens, browns and blacks. In addition to your paint tubes you will need the following supplies: 14 x 17 inch pad of smooth Bristol board sheets, a thin black Sharpie marker, palette or palette paper, paper towels and a 1.5 inch hardware store putty knife. For example, all cadmium red samples should be applied next to each other for ease of comparison on the cards. To make your own cards, first sort your tubes by color and keep the tubes with the same pigment together. How the same color from different manufacturers varies in tone and value.gets a waxy haze over the color sample, a sign the paint may have wax added to it. You can compare the dry sample to fresh tube color. Very oily paint will leave an oil ring on the card and can give you clues to how much pigment vs. If the color’s value or hue looks different when it is applied thickly or thinly. How transparent or opaque the paint is.They can even be useful to help you quickly find the right color for an unusual painting subject. They are essentially paint swatches from each tube of paint you own. If you have been painting for a while you may have a large collection of paints in many assorted colors or even multiple tubes of the same color from different manufacturers! Draw down cards can help you compare your paints and tell you a great deal about your colors. What They Can Teach You About Your Oil Paints Humiliated by her own transgression, Princess Komand'r swore vengeance and joined the Citadel, quickly rising through their ranks to become a warrior-maiden fighting against the forces of her own world and, ultimately, her own family. As a result, she was expelled by the Warlords. Princess Komand'r's true feelings were exposed when during a sparring exercise she attempted to kill her younger sister. Princess Komand'r's hatred continued and intensified when she and her sister were sent, per Tamaran's warlike custom, for warrior training with the Warlords of Okaara. ![]() Inwardly, Princess Komand'r's rage grew and her resentment turned to hatred for her own world, her people, her family, and lastly her younger sister who, in Princess Komand'r's eyes, made the fateful mistake of being born. Her privileges, honors, and her royal style and dignity were transferred to her younger sister, Princess Koriand'r (who would later become known as Starfire) and their long-lost younger brother crown Prince Ryand'r (known as Wildfire). As a result, though first in the line of succession, she was denied her birthright to be the next Crown Princess of Tamaran to maintain the respect and prestige of the royal family. Because of Princess Komand'r's naturally grim disposition, a stark contrast to the royal family's generally contented outlook, the subjects of Tamaran hated her. To make matters worse, Princess Komand'r was crippled by a childhood illness that left her unable to harness ultraviolet light into energy to fly like most Tamaraneans. Though she was in no way at fault for what had happened, Komand'r was, for all time, inextricably linked with that terrible day. On the day she was born, the Citadel Empire attacked and destroyed the western Tamaranean city of Kysarr and killed three thousand citizens in her name. The first princess born in over a century, she should have been courted and showered with honors. Princess Komand'r is the firstborn child and eldest daughter of Tamaran's royal family.
